Bildy Terms of Service

The following Terms of Service ("TOS") are between you (and the organization you represent) and Aisti Medialab Oy ("Aisti" or "we") and constitute a legal agreement that governs your use of the Bildy product, service and website. By using Bildy editor or other Bildy web services ("Bildy"), you agree to be bound by this TOS.

Aisti may update or change these TOS (including pricing). We recommend that you review the TOS on a regular basis. You can review the most current version of the TOS at any time at http://new.thebildy.com/terms Updates and new features on Bildy are subject to the TOS.

Violation of any of the terms below will result in the termination of your Account. While we prohibit such conduct on the service, you understand and agree that Aisti cannot be responsible for the Content posted on the Service and you nonetheless may be exposed to such materials. You agree to use the Service at your own risk.

For account owners

• You must be 13 years or older.
• You can get your account by creating one on the Bildy website (http://new.thebildy.com), while installing a new Bildy site or through an invitation. By using the account, you agree to the TOS.
• The account you created or created for you, is for your personal use only. Single login used by multiple people is not allowed.
• You are responsible for choosing or changing a strong password and keeping your account information secure. Aisti cannot and will not be liable for any loss or damage from your failure to comply with this secure obligation.
• You are responsible for all content posted and changes made to any Bildy site. For any damages or violations you do to any Bildy site, you will be held liable for the site owner.
• You may not manipulate in any way information that Bildy sends to the site. You may not forge or tamper any HTTP or TCP-IP packet headers or content that are sent between your computer and Bildy.
• You may not use Bildy for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including copyright laws).

For site owners

• You are liable to your local authorities for the content and service you provide on your site. Aisti cannot and will not be liable for anything your site represents.
• Your site's developers and updaters are held liable for you for all the content and changes made to the site. Aisti cannot and will not be liable for changes made to your site.
• We do not collect or store any of your server's passwords. Bildy communicates to your site by a unique proxy.
• We do not store or analyze any of the content that Bildy sends to your site. Your web server (and other services present) are solely responsible for saving and storing your information. We may provide features and services that handle or store your data or parts of it in our web servers. In these cases, we will notice you before using this service.
• We will provide extensions (for example controls or modules) that you can download and install on your site. We will test all the extensions published in the Bildy web service and ensure that they will not harm you or your site. Aisti cannot and will not be liable for extensions created by your developers or provided by third parties.

Payment & refunds

• You agree to pay all fees and charges specified when you install your Bildy site and any part thereof.
• 30-day trial time will start from the day you install your Bildy site. Site owner is requested to enter credit card information during this trial perioid. If payment information is not given by that time, Bildy service will be locked for the site until the payment information is provided.
• If the site owner cancels the subscription during the 30-day trial time, nothing will be charged.
• After 30-days, Aisti will charge the monthly subscription fee and any other additional fees you authorize to the charge or credit card account provided by the site owner. By authorizing us to charge a credit card for the fees associated with your subscription, you are authorizing us to automatically continue charging that cardfor all fees or charges associated with your subscription including any renewal fees.
• Your billing date will be every month the day your 30-day trial ended. If this date over the 28th day, your billing date will be moved to 1st day of the next month.
• We require to check and update your payment information yearly. A notification of the checkup will be sent to the site owner.
• Individuals and Finnish companies subscribing our service are subject to the Finnish VAT (22%). VAT will be added to the price given on the site.
• All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.
• Bildy site is billed in advance on a monthly basis and is non-refundable. There will be no refunds for the partial month of service.

Cancelling and re-opening the service

• Site owner may cancel the subscription at any time. There will be no refunds for the already payed days of service.
• When you cancel the subscription, your site will continue operating normally. However you may not edit or access your site through Bildy until you reopen the subscription.
• You may reopen closed subscription at any time. We will charge one months fee for opening the account and billing for your site will start imidiatly.

Changes to the service

• Aisti reserves the right at any time and from time to time to update, modify or discontinue, temporarily or permanently, the service or any part it with or without notice.
• Prices are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the Bildy web site (new.thebildy.com) or in the Bildy.
• Aisti shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
• In case we discontinue the service permanently, we will provide the Bildy client for our clients as-is.

Copyright & licenses

• Aisti does not claim ownership or intellectual property of the materials and/or content you submit to or make available through the service.
• Codes and the look-and-feel of Bildy is owned by Aisti.
• Bildy Engine (including B:tags) is licenced with Open Software License v. 3.0
• The names and logos for Bildy, Bildy Engine and B:tags are trademarks of Aisti Medialab Oy.
